The Market Court has rejected Fingrid’s appeal concerning regulatory methods
The Market Court has issued its decision today, 21 November, on Fingrid’s appeal against the Energy Authority’s decision issued on 29 December 2023 concerning the regulatory methods for determining the regulatory return for electricity transmission grid operations for the years 2024–2031. The Market Court rejected Fingrid’s appeal in its entirety and upheld the Energy Authority’s decision.
According to Fingrid, the decision by the Energy Authority represents a significant weakening compared to the regulatory methods that expired at the end of 2023.
The Market Court’s decision is a disappointment for Fingrid. The current regulatory methods decided by the Energy Authority undermine the company’s ability to develop the transmission grid in the future in a way that keeps Finland an attractive destination for green transition investments. The methods do not support Fingrid’s ability to implement contingency measures required in the weakened security environment, nor do they ensure the reasonable regulatory return stipulated by the Electricity Market Act.
Fingrid’s claims concerned the valuation of grid assets, the calculation method for the return base, the incentives of the regulatory model, and the way business risks are assessed and considered in the return calculation. In addition, Fingrid demanded that costs and investments related to contingency for prolonged crises be taken into account in the regulatory methods.
Fingrid will examine the reasoning of the decision in more detail and assess possible further actions.
