The Market Court Returned the Handling of the Determination Principles for Fees Related to the Olkiluoto 3 Protection Scheme to the Energy Authority

The Market Court has issued its decision today, 7 November, in the case concerning the determination principles for fees related to the Olkiluoto 3 protection scheme. The Market Court annulled the decision of the Energy Authority and returned the matter for reconsideration by the Energy Authority.

The appeal concerned the decision issued by the Energy Authority on 30 December 2024 regarding the determination principles for fees related to the Olkiluoto 3 protection scheme, which both Teollisuuden Voima Oyj (TVO) and Fingrid had appealed. The Market Court annulled the Energy Authority’s decision and returned the matter for reconsideration. The Market Court considered that the Energy Authority’s decision was open to interpretation and insufficiently reasoned and assessed.

Fingrid will examine the reasoning of the Market Court’s decision in more detail and assess possible further actions.

According to Fingrid, the protection scheme is a solution solely agreed upon for the needs of Olkiluoto 3, and therefore TVO should be responsible for its implementation, operation and the associated costs.

In its previous decision on 12 September 2025, the Market Court considered that Fingrid had the right to set protection related terms and conditions for those connecting to the transmission grid.

The Olkiluoto 3 protection scheme, is a technical arrangement that enables the electricity production of the Olkiluoto 3 power plant to exceed the maximum value of 1300 MW allowed by the electricity system.
